 Q & A Updated 10/8/09

1.)    Can a skilled trades EIT employee apply for a skilled trades position under Appx. A (Appendix A) or are they only entitled to apply for production openings?  (example Mechanical Device employees who had their classification eliminated last year and subsequently entered into EIT retraining agreements in other trades)

When employees are retrained under the provisions of Document  # 63 and/or # 112 the National Parties recognize these individuals as "employees in training", sometimes referred to as EIT or JIT (Journeyperson in Training).  The employee retraining into the new core skilled trade will only be recognized as an "EITS and/or Journeyperson when all the National Party approved training has been completed.  Therefore, whether the facility recognizes these employees in training as EIT or EITS the National Parties have agreed these employees will not be eligible until their training has been completed to apply as a Journeyperson in their new trade.

2.)  What are the Appx. A (Appendix A) rights of employees who are placed on Formal Leave w/o Corporate paid benefits?  Do their applications remain active?

They are coded as L34 - Layoff with no corporate paid benefits.  These employees are eligible for recall only to their home plant.  Their application in the Employee Placement System is not active.

3.)  What are the Appendix.A rights of employees once they have exhausted their TSP (Transition Support Program) payments?  Do their applications remain active?

They are still eligible for Appdx A treatment and have an active application as long as they have not gone time-for-time or otherwise lost their seniority.  If an employee were to take the TSP  lump sum payment they are considered a quit and are not eligible for Appx. A treatment. Or a Mutual Satisfactory Retirement

4.)  Can a production employee on layoff turn down a non-volunteer job offer and apply for a MSR (Mutual Satisfactory Retirement) if they otherwise meet the Standards of the MSR program?  Do they have to apply for the MSR right away or because they are from a closed plant and meet the standards, can they stay of layoff status and apply for the MSR at a later date?

YES employees can turn down the job and still be eligible for an MSR (if they otherwise meet the Standards of the Pension Plan). They do not have to take the MSR right away and would still be eligible at a future point as long as they have not broken seniority and otherwise meet the Standards.  Their status would be L34 – Layoff with no corporate paid benefits. I.E.Sub or medical benefits

5.)  Are people who currently have accepted an offer for an Appx A transfer still eligible for a 96 move?

NO.  Once you have accepted a job offer under Appx A you are not eligible for a Par. 96 job offer.
